All our online sales to individual customers in France are governed by these General Terms and Conditions of Sale (GTCS), which take precedence over any purchase conditions unless expressly stated otherwise. They override any differing or contrary clauses found in the client’s documents, correspondence, or orders. Any exception must be subject to prior, express, and written acceptance by the seller. The fact that the seller does not invoke one of the clauses of these GTCS at any given time cannot be interpreted as a waiver of the right to invoke it later. If any clause of these GTCS is declared null, illegal, or unenforceable in whole or in part, the remaining clauses shall remain valid and in full force.
1. Geographic Scope
Orders placed through the website are reserved for private individual customers and for the delivery of champagne within mainland France only.
2. Product Characteristics and Availability
The products offered are those presented on the website pages and are available while stocks last. Champagne should be stored in a cool, dark, and stable-temperature environment (ideally between 10°C and 12°C, bottles lying flat). Unless otherwise stated on the product sheet, champagne should be served between 8°C and 10°C. Bottles must be opened by an adult, following these steps:
Remove the foil covering the wire cage. Loosen the twisted wire loop. Keep your thumb firmly on the cork to prevent it from popping out unexpectedly. Gently twist the bottle (not the cork) to ease the cork out. Allow the cork to pop gently while holding it, and never point the bottle at guests. If needed, use a towel to secure your grip.
3. Prices
All prices listed in the catalog are in euros, including VAT applicable on the day of the order. Any change in the VAT rate may be reflected in product prices. The seller reserves the right to modify prices at any time, but the price charged will be the one displayed in the catalog at the time of order. Prices are valid for mainland France only. Shipping costs, customs duties, and any administrative fees are the sole responsibility of the customer.
4. Orders
Customers place their orders via the website. To purchase one or more items, the customer must follow the order process:
- Select items and add to cart;
- Validate the cart contents;
- Enter billing and delivery addresses;
- Accept the General Terms and Conditions;
- Validate payment by credit card.
Champagne Feneuil Coppée’s customer service will contact the buyer to confirm order details and delivery address. The customer will then receive an order confirmation email.
5. Order Cancellation
The seller reserves the right to refuse all or part of an order from a customer:
- If the quantity ordered or the frequency of orders appears excessive compared to standard private consumer behavior;
- If the customer has an unresolved payment dispute or lacks legal capacity to contract.
Furthermore, the seller reserves the right to reject any order exceeding 60 liters per month or any order indicating that the customer is a professional and not a private individual.
6. Payment Terms
Purchases are paid for by credit card through a secure online payment service.
7. Retention of Title
Ownership of the products remains with the seller until full payment has been received.
8. Shipping and Delivery Times
Orders are prepared within a maximum of 72 hours after full payment has been received by Champagne Feneuil Coppée. Delivery is carried out by a carrier and must not exceed 15 days. Delivery times are provided in good faith and are for reference only. Unless otherwise expressly stated in writing, delays cannot justify order cancellation or compensation. Shipping costs are shown at checkout. Risk transfers to the customer upon delivery to the carrier.
In case of damage or missing items, the customer must notify the carrier with detailed reservations via registered letter with acknowledgment of receipt within 3 days, and a copy must be sent to us. Products not subject to such claims will be deemed accepted and the seller released from any further liability. If the products are not claimed within 15 business days following the carrier’s delivery notice, they will be returned to the seller, and the buyer will be refunded minus round-trip shipping costs.
9. Product Warranty
The seller is liable for any lack of conformity of the products delivered in accordance with Articles L.217-4 et seq. of the French Consumer Code, and for hidden defects as per Articles 1641 et seq. of the French Civil Code. Any complaint regarding a product defect, incorrect quantity, or error in references compared to the order confirmation must be made within seventy-two (72) hours of product receipt. The client is encouraged to contact the seller within this timeframe, without prejudice to any recourse the client may have against the carrier.
10. Right of Withdrawal
The customer has a legal right to withdraw from the purchase within fourteen (14) days of receiving the order, without penalties, and may return the product for an exchange or refund. Return shipping costs are at the customer’s expense. The seller will issue a full refund as soon as possible, and no later than 14 days after the customer has exercised their right of withdrawal and returned the product. Returned bottles must be unopened and in perfect condition, including intact labels. They must be sent back in a state that allows resale, preferably in the original packaging or equivalent packaging ensuring safe transportation. The customer must keep proof of shipment. Without such proof, no exchange or refund can be made in the event of a lost parcel.
11. Liability – Force Majeure and Unforeseeability
The seller shall not be held liable for website failures or product unavailability. The seller’s obligations will be suspended in the event of force majeure, as defined by French law and jurisprudence, for the duration of such circumstances. Any resulting delivery delay shall not be attributable to either party and shall not justify termination of the order. The application of the legal theory of unforeseeability (“imprévision”) is expressly excluded by both parties.
12. Personal Data
Only the personal data necessary to fulfill the contract and maintain customer relations are collected. This includes the customer’s first and last name, address, email, and phone number. Processing is based on the customer’s consent given at the time of account creation or order placement. Your data is not shared with third parties nor transferred outside the EU. Appropriate technical and organizational measures are taken to ensure data security. You have the right to withdraw your consent and to access, correct, delete, restrict, or oppose processing, as well as the right to data portability. You may exercise these rights by contacting us directly or by reaching out to the CNIL.
13. Protection of Minors
French law prohibits the sale or offering of alcoholic beverages to minors. By placing an order on our website, you confirm that you are of legal age and have the legal capacity to enter into this contract.
14. Mediation
In the event of a dispute, the customer is informed of the possibility of using a conventional mediation procedure or any alternative dispute resolution method, provided the issue was not resolved through a prior complaint submitted to the seller. If no satisfactory response is received within one month after submitting a written complaint, the customer may contact a consumer mediator free of charge within one year of the initial complaint.
15. Governing Law and Jurisdiction
In case of failure to resolve the dispute amicably and through mediation (available only to consumers), either party may, after a 15-day period, refer the matter to the competent court of the judicial district where the seller’s registered office is located. French law shall apply.
